The Biden-Harris administration's policies have done more damage to women's sports than many realize. President Joe Biden signed an executive order on Day 1 directing the entire government to infuse gender ideology throughout the nation. This means that boys, including 18-year-old seniors, must have access to girls' locker rooms and sports if it aligns with their internal sense of self. Schools are now required to implement radical policies that treat men as women, even in the locker room. This is not only illegal but also has a direct impact on the safety and opportunities of female athletes.

For example, the Nevada Wolf Pack women's volleyball players have faced challenges with policies that allow men to participate in women's sports. This not only endangers the safety of female athletes during practices and matches but also silences them from speaking out. Multiple courts have agreed with the Department of Justice's finding that a Connecticut policy permitting men in women's sports cuts against Title IX's core purpose of ensuring equal opportunity for women in educational programs, including sports.

Steps to Protect Women's Sports

To protect women's sports, several steps need to be taken. One important step is to announce a high-profile Title IX investigation, like that of San Jose State University, and follow through to rescind their federal dollars. The Department of Justice found that such policies cut against Title IX's purpose, and multiple courts have agreed. The Department of Education Office of Civil Rights should also immediately announce an investigation into schools that fail to protect women's sports, such as San Jose State University, which continues to permit males to take roster spots and endanger women.

In addition, it is crucial to rescind all guidance that illegally represents that Title IX covers gender identity. Title IX is a 1972 law designed to stop schools from discriminating against women, not to impose a gender ideology mandate. The Department of Education should delete all such guidance and return to the original purpose of the law.

Enacting a New Title IX Regulation

An ideal end solution is to get the federal government out of the school business and return it to the states. In the meantime, a new Title IX regulation should explicitly protect women's sports. The longstanding regulation states that schools "shall provide equal athletic opportunity for members of both sexes." Trump's Department of Education should add that equal opportunity requires a reasonable number of female-only teams and private spaces. The regulation should also define female as an individual belonging to the sex that has the reproductive role of producing ova.

Whacking the NCAA is also necessary. The NCAA is a multi-billion-dollar organization that strips women of opportunities by permitting post-pubescent males in the female category. Before supporting any NCAA wish list items, the organization should comply with Title IX's purpose of protecting women's sports.

Asking for Supreme Court Review

Three states (Idaho, West Virginia, and Arizona) are currently unable to protect women's sports due to rogue court interpretations that the 14th Amendment and Title IX require men in women's sports. Asking the Supreme Court to review and overturn these unhinged decisions is a crucial step in protecting women's sports.
